I and/my child (minor under 18, herein referred to I/my) understand and acknowledge that I have voluntarily chosen to participate in activities at Friends & Allies Bouldering Gym and / Scallywags Climbing (hereafter referred to as the Gym) and/or to enter the facilities, including but not limited to the following: Climbing, bouldering or spotting. Yoga, use of fitness equipment, and other facilities within the Gym, included but not limited to climbing, bouldering or exercising. I understand that I will not be supervised by the Gym staff and am solely responsible for my own actions.
Acknowledgement
I recognise there are significant and inherent risks, which may or may not, be fully listed in this waiver associated with the Gym. These dangers include, but are not limited to: Falling, striking or landing on padded or unpadded surfaces. Being injured by actions or inactions of other participants, or the negligence of the Gym or others. Movement of climbing holds, equipment failure of any kind. Physical, mental and emotional injury or illness related engaging in a physical activity.
Risk Assumption
Despite the risks involved in the Gym activities, I AGREE TO ASSUME ANY AND ALL RISKS OF INJURY, ILLNESS, EMOTIONAL DISTRESS AND/OR DEATH, both known or unknown that might be associated in my participation in the Gym activities, including but not limited to: Climbing, bouldering or spotting. Yoga, use of fitness equipment, and other facilities within the Gym.
Agreement Never to Sue
I AGREE NEVER TO SUE AND I AGREE TO RELEASE THE GYM FROM LIABILITY for any damage injury, illness, emotional distress or death to me arising from the participation of the activities or use of the Gym, regardless of cause, including the alleged negligent instruction, with the exception of claims that cannot be released under applicable law.
Indemnity
If I, my child, heir, estate or legal representative files a claim or lawsuit arising out of my participation in the Gym activities and facilities, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS the Gym from any and all damages, legal fees and costs arising from such a claim or lawsuit.
Insurance
I represent and certify that I have adequate insurance to cover any injury or damage that I may cause or suffer while participating in the activities or that I agree to bear the costs if such injury or damages to myself.
Photo and Video Release
I agree to the photographing and videoing of the activities and participants including me. I agree that these photographs and videos of me may be used for any lawful purpose, including but not limited to: Marketing, publicity and illustration, Web content, Evidence in litigation.
I HAVE CAREFULLY READ THIS AGREEMENT AND I UNDERSTAND THE CONTENTS. I AM AWARE THAT THIS IS A COMPLETE RELEASE OF LIABILITY AND A BINDING CONTRACT BETWEEN MYSELF AND THE GYM. I HAVE SIGNED THIS OF MY OWN FREE WILL AND AGREE TO BE BOUND BY THE TERMS IN THEIR ENTIRETY.
